Understanding Photographic Copyright

“Copyright” describes the rights given to creators for their literary and artistic works.

But we often don’t consider copyright when we look at our family photos, or go to get them copied.
Even though it is so easy to copy an image—with scanners, photo-quality printers, and copy
stations—it is still illegal.

Things to remember about copyright:
• Copyright is a property right.
• Just because you buy a print does not mean you have purchased the copyright.
• Professional photographers are the smallest of small copyright holders.
• Under the Federal Copyright Act of 1976, photographs are protected by copyright from the
moment of creation.
• Photographers have the exclusive right to reproduce their photographs (right to control the
making of copies).
• Unless you have permission from the photographer, you can’t copy, distribute (no scanning and
sending them to others), publicly display (no putting them online), or create derivative works from
photographs.
• A photographer can easily create over 20,000 separate pieces of intellectual property
annually.
• Professional photographers are dependent on their ability to control the reproduction of the
photographs they create.
• It affects their income and the livelihood of their families.
• Even small levels of infringement—copying a photo without permission—can have a devastating
impact on a photographer’s ability to make a living.
• Copyright infringements—reproducing photos without permission—can result in civil and criminal
penalties.

Put copyright in perspective:
• 65% of PPA photographers are self-employed photographers relying exclusively on photography as
their primary source of income.
• 47% of member studios rely on reprints as a profitable source of income.

How to get legal copies of professional photographs:
• Contact the photographer/copyright owner. Photographers are happy to discuss options for
reproducing photos with you.
• Check both the front and back of a print for a copyright notice. If it is a school, sports or
similar
type photo, you may want to contact the institution where the photo was made.

I LOVE technology!

WOOOOO!!!! Booking weddings with Jireh Photography just got a whole lot easier and more flexible! We are now able to fully automate the booking process online via our website! This means that potential clients will still get our 1 on 1 personal consultation experience but for those clients that are not too sure what products they would like to book from us, they will have the option to select a package, sign the contract, book the day and pay the retainer all online without any extra travel time or gas being used! Why do photographers charge so much?

I recently stumbled across a blog post from Darbi G. Photography that really sums up what I have a really hard time expressing in words. I have copied and pasted what she wrote onto this blog for your ease of reading but please understand this post is from Darbi G. Photography and I have made every effort to make sure she gets link backs and full credit for her post. Without further ado, here is some good reading for you…

People tend to forget that photographers need to make a profit, or else they wouldn’t do it. It’s a business. We all work to make money, right? Yes photographers are lucky to have found something we love to do that we can make money doing…but does that make it any less important to be able to provide for ourselves and our families? So if photography is our business, we have real business expenses. Expensive equipment, expensive software, expensive maintenance fees for sites, gallery platforms, marketing, accountants, sample products, workshops to learn even more and bring clients even better work, assistants and so forth. Plus all the boring stuff like utilities of the actual office/studio etc.

Before digital, people bought prints, and that is where photographers could turn a profit. Now people want files. And photographers will usually sell them to you … but for a price.

We can’t just give art away.

Look at it this way—a typical wedding is 8-12 hours of shooting. Then after that, processing the images and getting them ready for viewing ranges from 20-40 hours. (Depending what else is in packages like slideshows, albums, blogging, etc..) Add on to that the cost of doing business. The cost of time. The cost of something that should be considered ART.

Lifestyle sessions only last 2-4 hours…for shooting. But there is more than just showing up with a camera. Marketing, communication with the client, processing, uploading, blogging, packaging, etc.

And of course the 25-35 percent we lose to taxes, just like all other working folk.

So let’s say a wedding photography package is $2700. Nearly $900 goes to taxes, another $900 goes back in to the business, that means the photographer “makes” $900. Factor in the time of shooting, the time of processing, uploading, meeting with clients, communicating with clients, burning discs, finetuning files, and all the other in-between things that aren’t worth listing……it results in $22/hour (if all of the above takes at least a week to do, a minimum of 40 hours…which usually takes more….). Compare that to other CAREERS out there. You’ll see it’s not that much.

So enter the digital files. Why put all that time into the art, when you basically only got paid to shoot and process, but not for the art itself? (to see examples of what is the difference between a picture taken and a picture processed… go here) For lifestyle sessions, I charge $350 for the 100-200 images on a disc, print ready. That’s a bit more than a dollar to $3.50 each…for ART. If you were to buy a 4×6 print of those same 100, that would be $1000 in my pocket. Using print prices, each 4×6 is $10 (through me) for $750 that I charge for wedding images on disc, you’d only get to buy 75 4x6s before you spent that amount. By buying the files, you can make whatever size, however many times…16x20s… 11x14s, you name it. The value far exceeds the cost.

Also…another thing most fail to consider: Target, Walmart, Walgreens, kodak.com and other similar retailers that offer print services have sub-par print quality. I’ve done print tests, and there truly is a difference between those and the professional labs that photographers use. We calibrate our monitors to those printers. We ensure it comes out looking like it’s supposed to.

When I release my files, I run the risk of having my name attached to less-than-my-best work because the skin tones might be too orange, a sepia tone that might be cringe-worthy could be used, a crop job might screw up the composition of the photo or a black and white rendition ends up flat and boring. By allowing clients to print whatever they want, to actually have the files, we are allowing clients to change a picture from the way we, as artists, intended it. It’d be like buying a painting and then painting over it in parts.

Photographers have no quality-control once the disc is in the client’s hands. Most photographers will relinquish that control. But again…they do so for a price.

As for albums, the wholesale price is typically 1/2 to 1/3 of what the photographer charges. It takes a lot of time to lay out an album, re-edit the photos, design it, upload it, communicate changes with the client, make the changes, reupload and then finally send off to the printer. So for the 12×12 that I charge $1,250 for…. remember that 1/3 of the remaining amount after the cost of the album itself and shipping… goes to taxes. 1/3 goes back into the business. 1/3 goes to our pockets. So again, that is maybe $250 in my pocket… for 15-20 hours of work.

Bottom line is… the pricetag looks pricey. But when you realize the ESSENCE of photography is ART AND BUSINESS… we’re not making fortunes. We’re TRYING to make a living. There you have it in a nutshell. Good photographers love what they do. To make a living at it takes tons and tons of work. If you work for anyone else, you expect to get paid for your time and skill and you probably expect benefits too. We’re no different. Just food for thought.

The BEST shoes EVER!!!

Detroit wedding photography -My shoes {focus_keyword} The BEST shoes EVER!!! MG 3857 e1393513781403Photographers love to chat it up about their gear. Especially if we’ve got something new. I see lots of posts and articles about a photog’s latest lens or new camera body. I see some fabulous wedding photographers showing what’s in their camera bag for a wedding shoot. This often times makes me wonder “what kind of shoes are they wearing”?

For me, weddings are a LOOONG day. After 8 – 10 hrs of walking running (more like a hurried walk) and standing around my feet are THRASHED!!! I bought some Dr. Scholls shoes called Influence and they are fantastic shoes. I’ve have them over a year now and found myself needing to replace them. To my dismay, I discovered that they no longer make the shoe. So, frantically I’m searching Amazon, Ebay and anything else, to no avail, when finally my wife says “take a look at these”.

These shoes are called Exersteps. First time I’ve ever heard of them. Now, ordering shoes online can be a bit of a crap shoot so I was a little apprehensive. But after finally getting them and putting them on… OMG!!!! These shoes are AWESOME! It’s like they propel me forward, encouraging me to walk MORE!, LOL!

The bottom of the shoe is rocker shaped and they relieve a lot of the strain from my heels and arch. Now to be honest, they don’t really seem to be made of the finest materials but if they can get me through this wedding season they’ll be well worth it. At any rate I plan on getting another pair very soon as backup. Every good photographer has backup gear right?

So, to conclude my shoe mini review, I have to say that these are the best walking shoes I have ever worn. Bye bye sore feet! Wedding photography days just got THAT MUCH FUNNER(?)!

Detroit Area Wedding Photography – Meet our WINNERS – Brandon and Holly!

Finally got to meet our wedding photography give away winners yesterday. WHAT AN AWESOME COUPLE! Two of the most down to earth, genuine people I’ve met. Their wedding is in April of 2015 and they already have most of their planning accomplished. I’m so honored to be a part of their EPIC day. What’s even MORE humbling to me is that they told me even if they hadn’t won our contest they would have chosen me to do their photography anyway because they loved my work. WOW! They are MY clients!

Their story really touched my wife and I and we were incredibly compelled to offer this prize to them. I can honestly say without a shadow of a doubt, that we made the correct decision. We’re planning their engagement shoot right now so stay tuned for those images. Their wedding day is going to be AWESOME and I can’t wait to showcase the images that are captured!

Today’s favorite image of 2013…

Today’s image is from one of my first couples, Lamont and Summer Foster. I love shooting images of them because they trust me and pretty much let me do what I want. They are such an attractive young couple and I pray that they are blessed beyond measure in their marriage.

Summer and Lamont were married on New Year’s Eve and we started out taking their images outside on Belle Isle. NOT fun. WAYYY too cold! so we decided to get inside, to the RenCen’s Westin Hotel. Everyone was partying it up and having a great time while we walked around and grabbed some great images. Truth be told, there are quite a few images from their wedding day that I could mark as favorites, but in the interest of space and to keep you coming back for more (I love cliff-hangers) I’ll start with this one!

This image is of Elmer and Paula Drummond at the Grosse Pointe War Memorial in Grosse Pointe, MI. I love to tell the story behind this image. It is rather long so I won’t go into details but I will say that Paula was not going to get up on that wall for ANYTHING… except her new husband! I hated to use her own words against her just to get the shot but hey, a photographer’s got do what we can to get the shots our clients will love.

I think more than anything, just the experience of being up there with her new husband and the thrill of it all, made Paula smile so big it was awesome to see. I’m so glad my clients trust me to do some seemingly crazy things to capture one of a kind awesome images for their home.

Can’t wait to see what 2014 holds…

Because of the many blessings that we have received, our desire is to be a blessing to someone else whenever we can. While weddings are an EPIC, special day they can also get to be very costly. Our aim was to help to alleviate some of the  cost from a couple’s wedding while still capturing their special day with passion, artistry and excellence. This is why we created this contest! The goal was to “move us” with your stories and to some degree ALL of the entries did just that. We received quite a few entries and my wife and I went over every one of them. Some even two or three times! I must say, it was VERY difficult selecting a clear winner for our contest.

In the end we did make a final selection.

Here is their story…

Dear DeAndre,
We are so excited at the prospect of being a candidate for your free wedding package giveaway and would love to share our love story (and a picture – attached) with you!
My name is Holly, my fiance is Brandon.
Brandon and I attended the same high school, grew up just streets apart in the same neighborhood, and I was secretly madly in love with him all through my teenage years. However, he was two grades ahead of me and I am sure he did not even know I existed.
When I was eighteen, my sister started dating someone new and invited me to a party at his house where – low and behold – Brandon was also invited. I was incredibly nervous, reluctant, and hesitant to go and talk to him. But to my amazement, he started talking to me first! It was like a dream come true. We have been nearly inseparable for the last 5 years and I am so proud to say that I will soon be able to call myself Mrs. Brandon N.
Soon after we started dating, however, Brandon was diagnosed with a kidney disease called IgA Nephropathy (or Berger’s Disease), where his kidneys produce and store too much IgA protein, leading to damage of the kidney tissue. It is a slowly-progressing disease, currently without a cure. Unless a cure is found soon, the disease can eventually progress to induce kidney failure within 10 to 20 years, requiring dialysis or a kidney transplant. We hope to be able to avoid this, but one of the next steps to attempt to treat the disease and prolong it’s effects is long-term steroid treatment. Long-term steroid treatment can, unfortunately, lead to infertility. Due to this frightening possibility, it is our hope that we can save as much money as possible on our wedding so that we may begin to try to conceive a child immediately following the wedding.
We are a very laid-back couple, who love each other very much and receive gratification from indulgence in life’s simple pleasures. It was our pleasure to share out story with you and we will be anxiously awaiting to find out who the winner is on Valentine’s Day!

Today’s favorite image of 2013…

My favorite image for today is actually more of a favorite moment. This was Gary And Amanda’s wedding day and as Amanda is getting ready her mom is slowly falling to pieces. To her credit, she held on for some time but when it came time for mother to see her soon-to-be-married daughter and speak to her, she could no longer contain the emotions that she was feeling. What a precious moment. I feel so blessed to be able to capture these for my clients.
